Yesterday I had occasion to take the RTA Bus from Provincetown up to Harwich. My plan was to take the Bus to the Harwich Star Market and from there to take a cab to the Evensong Retreat Center over at 326 Lower County Road. The Retreat Center is also in Harwich and a mile or less from the Star Market. The cab company that I called was Cape Cab which is advertised as covering the Cape or at least as far as Harwich. The Cab that came was a Cape Cab with the Cape Cab logo and printing on the sides.

I saw no meter or any other advertisement regarding fees in the Cab. Upon arriving at my destination I was told that the fee would be $25.00. This seemed, to say the least, excessive, given the short distance and the short amount of time I spent in the cab. When I complained about this fee, the driver called her dispatcher and the fee was reduced to $15.00. The last quoted fee still seemed excessive; however, I paid it rather than become engaged in further argument.

Needless to say, such a manner of conducting business in no way enhances the reputation of Cape Cab.

I hope you read the State Ethics Commission's findings which will be out soon Hazel Everett concerning the Finance Committee. While I have to be conservative in what I can say at this point, the Commission's investigation has 'opened other doors' and that's why it has taken over four months since I filed it. It's not about not liking someone, its about several local appointed and elected officials not adhering to the laws of governance whether they be local, regional, state or federal. I don't know Brian DeLaurentis but challenged his representation of me and signing a petition to fire a town staff member (the Chief) without due process. Remember, Hazel, it's your choice to be a member of this page. I hope you stay as I appreciate reading some of your posts!

Provincetown Mooring Field Investigation Fiasco

I know I am going to pay for this, but,l have to respond to some of the outrageous claims being thrown around regarding moorings in Provincetown Harbor.

Seventeen years after Francis J. Santos as president of Flyer's Boat Rental Inc.

legally purchased moorings and mooring equipment from Jack Clark long time

employee Joe McKneill of a defunct business venture PYM and also from John F.

Noons excavation where said blocks sat in storage unpaid in Truro, the town

manager, police chief and apparently the media have chosen to report the

unfounded rantings of another business person in town, the infamous owner of the

Whydah Museum, Barry Clifford, claiming that he owns said moorings.

Further, and more disturbingly, they have contrived to invent a conspiracy

between now Harbor Master Rex McKinsey and now selectman

Santos that they worked together to steal these moorings or some such fantasy.

McKinsey was not harbor master at the time and did not and could not have had

any involvement in this deal. And even though the town manager recognizes this

fact she still insinuates an impossible connection in an apparent effort to unseat

McKinsey. Police Chief Jeff Jarren is quoted as saying the dealings between Santos and McKinsey, a former employee of Flyer's (it's a small town you know) "does not pass the sniff test."

If there is any stink in town, perhaps it is the relationship between the town

manager, a former police officer, and the police chief. Perhaps they have been derelict in their duties to properly investigate hearsay allegations before rushing

to town hall and the media with unfounded allegations.

If I were to follow their thinking, I would see a possible conspiracy between

the two to discredit two well respected members of our community for their

own political benefit and agenda.

It is clear to many in town that the chief is intent on taking over the harbor

master's office and add to his ever-growing empire. He states that he wants to

find lost revenue, but has no problem spending 5.3 million dollars on a new

police station. That amount wouldnt even cover the interest for a month on this

project.

Let us look at some facts-

The dispute over the defunct mooring field outside of the breakwater was

addressed by the previous Town Manager Keith Bergman and then Police Chief

Robert Anthony. This is covered in a memorandum of August 29, 1996. In this, the

false claims by Clifford could never be established.

Here is a quote from David Ditacchio, then Marine Superintendent (Harbor Master).

September 5, 1996:

"Since Clifford and or Lazier now claim ownership of 40 moorings in Provincetown Harbor, they should be advised immediately that the records of the Marine Superintendent contain no evidence that permits required by local and state law have been applied for or issued with respect to the 40 mooring and, further, that the records of the Marine Superintendent reflect that no fee has been paid by the PYM for the privilege of maintaining 40 moorings in Provincetown Harbor as required by local law."

To this day there have been no payments for this defunct mooring field to the

Town of Provincetown. If Clifford wants to bring payments up to date for 17

years it should just about bankrupt him.

The police chiefs suggestion that each of these moorings is worth $1,500 is

extremely ill-informed and is based on the cost to a customer of a complete,

installed mooring block with chain, ball and warp including all associated labor

costs.

What we are actually supposedly talking about is concrete blocks with chain

attached left sitting in the water for 17 years. The chain is long ago junk. The

top tackle of these mooring balls was undeniably sold separately. Which Flyers

Bought from John F. Noons with the blocks that were in storage. So the concrete

blocks might be worth $200 new to the trade.

That is conservatively half the commercial cost of locating each one by diving

and retrieving with a mooring barge. In any case, had they not been sold to

Santos, and instead remained in their original location with no mooring fees

being paid by Clifford, they would quickly have become town property.

In that fictional case, the cost of retrieving them would make them

essentially

worthless, especially as the town does not operate a commercial mooring field

and has limited use for them.

The only reason Clifford raised this matter now is because when the town

installed a number of experimental Helix moorings for private mooring customers,

they removed their old blocks, one of which had Pym # 43 engraved on it, and

dumped them for storage - because they don't have much use for them - at

Macmillan Pier bulkhead where Clifford spotted it and started this craziness.

Clifford then sent a diver into Flyer's mooring fields and, surprise, surprise,

found some blocks with the initials of the defunct business engraved on them.

Just because someone engraved initials on the top of their mooring blocks, does

not make them now the property of any particular person. They were legally

purchased by Flyer's... SEVENTEEN YEARS AGO. Many moorings in this town have

Flyers name on them but that does not make them Flyers property ­because we

sold them to private individuals.

At the time of the 1996 investigation, McKinsey had no involvement with the Town

of Provincetown. I have a document that proves the town manager and police chief have in their files all evidence pertaining to this investigation from 1996.

They claim the harbor master's records are a mess yet are referring to records

that go back at least two previous harbor masters before McKinsey. Maybe they

should address their own glass departments before throwing stones.

It is no secret in town that Candice Nagle and Mary Jo Avalar have separately

put exhaustive efforts into overthrowing McKinsey through claims of financial

mismanagement over a period of many years. They scoured Pier Corps records,

and if you know these individuals, you would know they would have found

misdeeds years ago if they existed.

Still the town manager is insisting on a costly independent audit of the harbor master's office even though we are addressing a time period that has no

relevance to the incumbent.

Regardless of whom you believe, the statute of limitations has long expired on

an ethics, civil or criminal case. Even the State District Attorneys office and

the police chief recognize that there is no evidence for a criminal

No town employees were shown this letter so no need for an executive session!

Do your Audit we have been paying for everything.

The NPFH committee met at Spin on Friday November 16, 2012 at the police station conference room. The Provincetown Police Department fully supports this page, Provincetown Citizens Against Mypacc.com, which is being used to help many Provincetown citizens who have been the victims of defamatory, libelous posts and invasion of privacy since 2007 by a Provincetown based hate blog administered by a Provincetown resident called Provincetown Association of Concerned Citizens (mypacc.com). I am the Chief of Police In Provincetown Massachusetts. I am contacting you about the face book page recently created by a Provincetown citizen,                , on July 18 2012. The page is called, Provincetown Citizens Against Mypacc.com. It was deleted yesterday (Aug 3 2012) by Face Book.

The Provincetown Police Department fully supports this page, Provincetown Citizens Against Mypacc.com, which is being used to help many Provincetown citizens who have been the victims of defamatory, libelous posts and invasion of privacy since 2007 by a Provincetown based hate biog administered by a Provincetown resident called Provincetown Association of Concerned Citizens (mypacc.com). The Police Department believes it was a concerted effort on Aug 2 by the webmaster to report abuse of this page to Face Book in order to shut it down so that it can continue to operate this hate blog unregulated at the same time continuing cyber-hate posts against Provincetown citizens.

As Chief of Police in Provincetown MA, I am requesting the immediate reinstatement of this the face book page, Provincetown Citizens Against Mypacc,com, as it is a resource for Provincetown citizens and victims of the biog, mypacc.com, to help them file complaints with its Internet Service Provider, (Register.com), offers links to articles on cyber-bullying, cyber-hate and cyber-harassment.

The Town of Provincetown Is working with the                          the Anti-Defamation League (an email from ADL was also posted on the face book page, Provincetown Citizens Against Mypacc.com) and the Provincetown No Hate Policy Committee to modify the policy to include cyber-hate, cyber-bullying and cyber-harassment. The face book page, Provincetown Citizens Against Mypacc.com is also providing the community of Provincetown action steps the Town is taking to address cyber-hate content in the blog mypacc.com by the Provincetown No Hate Policy Committee.

This letter is a response to your inquiry about the conflict of interest law, G.L. c. 268A, which applies to state, county and municipal employees while they serve the government and after they leave government service.

You have asked questions about whether a recently appointed Finance Committee member, Clarence Walker, has a conflict of interest because he is the webmaster for an anonymous blog called Provincetown Association for Concerned Citizens, mypacc.com. You explain that you and many other residents have felt that, over the years, Mr. Walker has not been objective in his expression of views on the blog, but rather discriminately posts views that reflect his own personal biases. As an example, you mention that he used the blog to advocate for election of a particular candidate for the Board of Selectmen who was running against the incumbent.

Unfortunately, I will not be able to help you with this question. I am a member of the Legal Division at the Ethics Commission, The policy of the Legal Division is that we give advice to public employees about how to comply with the conflict of interest law in the future. We do not give advice to one person about another person's conduct, and we also do not give advice about conduct that already has occurred.

Our Enforcement Division receives anonymous complaints about public employees' past conduct and investigates them. If the Commissioners find reasonable cause to believe that a violation of the conflict of interest law has occurred, the Enforcement Division brings a case against an individual, and eventually the matter may proceed to a hearing. If the Commission decides that an individual violated the law, a civil penalty may be assessed.
