Is Candyland gone? Are You Stating that her property finally sold?

If so, congratulations to all. glad to see her finally leave with guess who? Of
course, with Sharon and the other guy, Jeff Jaran. what a threesome.

I saw the listing but has it really sold? Tell me that it has and I will be
smiling through this last day of 2013.

A new year is surely here.

May the  town gain a sense of newness, of new energy, and of new hope in the
future. We are at a critical nexus and I think we have a great chance to move
forward with a more cohesive community. We are on our way and I hope that 2014
provides the avenue for our success as a more unified community. I don't mean
only one voice but many voices  together in our acapella enterprise.

Ethics Seminar on Wednesday January 8 at 9a.m. in the Judge Welch Room

good to have this seminar on ethics and what is and what is not allowed when you
are on a board or work for the town or are an elected official.

I absolutely agree with the anti-affordable housing posters. I'm
scraping by on a fixed income and I will not qualify for anything affordable so
I need everything I have to support myself without giving more than I do now to
many many charities.

15 YEAR LIMIT ON AFFORDABLE HOUSING LEASES

Tons of affordable housing was built in Provincetown.

TRUE FACTS.
1. IF the affordable unite wasn't rented or bought in a timely manner, it went
to a market rate rent.

2. Formerly, After 5 years they could be sold at market rate.

3. Many units reach market rate each year because their deed was for a limited
amount of years. Thus developers will have a market to build.

4. The housing person Michele J. isn't being transparent about THESE CONDITIONS.
All they point to is that Province Landing has a 99 year lease.

5. It is alleged that Mr. Ted Malone was given $800,000.00 of CPA money some
years ago--is it in his bank account or the towns? HOW MUCH HAS HE GIVEN back to
the town in revenue--it is the law that he do so.

6. Taxpayers are tired of giving millions to affordable housing developers.
Anyone can apply to live in them.

Who cares what Austin is now calling himself.  Everyone knows that Austin
Knight, Chairman of The Board of Selectmen, is decitful and unscupulous
(evidenced by his past actions and comments). A rose by any name is still a
rose, and this rose stinks!

Affordable Housing Available to All

Affordable housing developers use taxpayer money to develop their housing
developments. THE LAW STATES that any American Citizen living the Continental
United States, Hawaii, Alaska, or it territories like Puerto Rico are eligible
to come to Provincetown, get a job and put their name in the lottery for
housing.

Anyone with a section 8 voucher from anywhere in the continental US etc can go
to a landlord with their section 8 voucher.

I have personally talked to several people who came here two summers ago to get
a summer job to get their name in the lottery. I also know a person with money
who did the same.

That is the situation here. I own a house here, I work here, and I drive a
second hand mini van built is 2000. I personally know people with affordable
housing apts. who bought a new vehicle. As a taxpayer and struggling home
owner--I don't find this fair.

I don't have a town hall job, my hours were reduced a few years ago I have to
put money into my own IRA-but I've had to stop doing that. I will eventually
have to sell my house after living here several decades.

You want us to cry for you as you strive for your affordable housing--but it
will only be more and more of a burden on the taxpayers. Now folks want the town
to sell off property to create more affordable housing. WE aren't all rich
homeowners here. You want people to see your side and walk in your shoes but you
disdain anyone else who happens to own property and you act as though we are all
rich.

Happy New Year to All!

It has been quite a year and who'd have known that at the end of this year, we
would have an Acting Town Manager in David Gardner and we would have an Acting
Police Chief in Lt. golden.

Much happened this year and I want to thank so many people for making the next
year a great year be cause of what they did, what actions they took, and what
issues they publicly brought up at town meetings and BOS meetings.

Without you, we would not be in the midst of this much-needed change.

Thank you for every word, every act, every hard decision you made. It counts and
has counted,more than many of us can ever know.

Time to Look Back to See Who's Gone

This year it is not only those who have passed but key town officials. some left
with dignity as Vernon Porter and David Guertin, but others left--or just left,
as Sharon Lynn. and then there is Jeff Jaran, half here, half elsewhere. He is
not here but not yet gone. Still, it is good year ahead.

I look forward to a strong community with new faces and new people filling these
key town official positions.

Austin Knight

OK, this has become the latest issue this blog has put Austin on trial for, but
has anyone stopped to look into weather or not Austin legally changed his name?
If so, there's no issue at all, is there? I'm not defending him or claiming he
did legally change it, but does anyone have proof otherwise? Or is this just
more rumor mongering?

Thanks for the History of the Creche

However, that was forty-four years ago. It's great to know what happened then--but we
are a richer town and we can show more respect by having statues of the crèche.
Let's keep the old and put it in the background and purchase a more dynamic
manger. Life changes and after forty years and so much more money that has been
poured into this town, let's place an appropriate manger scene below the
monument.

Again, I appreciate the history which I didn't know but let's add to our own
history too! Can't we have a more impressive manger without losing the past
memories linked to the cardboard figures?

It seems to me that we can.

Affordable Housing

If the town does not Control affordable housingthen it is a developer's dream
and the town people's nightmare. with a developer, those who gain access to
affordable housing will not be town people, not those in need, but outsiders.

That is how developers get their money and they open the doors to anyone who
wants to be here---not those who have lived here for years and years.

and so we repeat the damage time after time. We give money and land to
developers, we empty our CPC funds, and we keep funding outsiders.

Will we ever learn? I doubt it. Another housing summit, another big time attempt
and what will happen? Outsiders will gain and developers will make millions and
the people you want to live here---will not. this has been the same scenario for
the last twenty five years.  Why would it change now if the game being played
and planned is the same? but some really believe they can make this happen.
sorry, the town has become quite rich, quite a rich-person's vacation place and
the way we approach affordable housing continues to open the places for
outsiders--and another housing summit will not change this.

We should learn from our past--but few do!

Can Someone Be Elected Under a False Name?

Given that Austin Knight/Philip Bliven appeared on the ballot as Austin Knight
appears to raise some key legal issues. Even his campaign financial form was
listed as Austin HighK---not Austin Knght.

Seems his election was flawed in too many ways and too many illegal acts were
involved.

Save the Library Please!

 

The library board and director ALWAYS turn to lying when the truth is
uncomfortable for them and the truth is ALWAYS uncomfortable for them. It is
true that the library is in shambles, employees are miserable, the director is
looking to bail and applying for jobs elsewhere, the trustees have terrible
relationships with each other, the president of the trustees isn't even capable
enough to lead the way out of the grocery store, the director IS playing
computer games in her office, the director's open-door policy is this: if you
open her door, you get the death stare.

Townfolk, please remember that the last time people were posting the ugly truth
about a town leader, this is what the defenders said:

1. All the stories are false
2. Everyone on the staff is happy and included
3. There "is not lid to blow off," and no festering secrets
4. There are 2 or 3 people who have made it their job to defame this person for
personal reasons,  and that can be detected because of "similar writing styles"

This went on and on AND ON until it became clear that is was WORSE than the
posters said. There was sexual harrasment, electon fraud, a no-confidence vote
by staff, and ugly, damaging lies being told about townspeople by this town
leader to his staff, and there were many many people posting about this person,
not just one or two.

The library is not the police dept and Cheryl Napsha is not Jeff Jaran. However,
the story is the same. Don't believe the defenders. They are the ones with
personal agendas and with some things to hide. Save the library. PLEASE.

Christmas Manger

A poster recently was disgruntled at the sight of the Christmas Manger
on the Bas Relief Park as not being attractive! Elegant  & glitz are sometimes
secondary to simplicity & sentimental value!

I'll repeat  the history of that Creche for those unaware! Some years ago (1970"s ?) when questions of placement of religious items,such as Mangers,on public places was unacceptable due to laws
separating Church from State, the issue was challenged in Supreme Court and the law reversal made it all acceptable  again! Based on that,I,as Assistant to the Board of Selectmen,Town Manager, & to the Town Clerk,was assigned a total $5,000 budget to be divided; 1/3 for Old Home Week in conjunction with Blessing of the Fleet festivities,1/3 for Fireworks,& 1/3 for Christmas decorations for Town Hall & other Town Bldgs. The meager sum of money didn't allow for "elaborate:!

My thought was to utilize the Manual Training & Art Classes at the High School,and that idea was sanctioned with permission from "the powers that be"! The participating students would be graded with marks by their supervisor/teachers ,The cost was less than the budget amt. of $1666.20,leaving enough for  door wreaths for Town Hall,Library, & Cape End Manor.

The kids that made & painted the project were invited to install it so they,the teachers & the school could get the publicity they so deserved!As an aside,I took one of my own kids dolls and made "swaddling
clothes" for "Baby Jesus" & the first night of placement it was stolen!

Joe Macara,owner of Lands End Marine Supply upon learning of the theft,generously donated a replacement. The 1st shed made by the school was larger but I was told that after years of transporting to & from storage it got too broken and a newer /smaller one replaced it which now makes the figures look too crowded & perhaps the figures have never been repainted?!The students were so proud of their combined efforts years before  & I'm told remarked ,with sense of pride, & legacy to their own children  what they were able to contribute to their community which happened in their High School when it was in existence!

I was out of the ranks of Town Hall when Church & State issues arose again for not recognizing other religious beliefs and therefore Kwanza & Menorah symbols were placed on the Bas Relief annually to honor them as well!I'm sure the Town would graciously accept a newer and perhaps more commercial Manger Creche if one were offered! The one now there could be upgraded and placed on another Town owned space!

It will be interesting to see if and how this affects the waitstaff in
Provincetown who now qualify for affordable housing as a result of not reporting
tips, people we all know are raking in a fortune and living a pretty sweet life
by working the system.

can buy all the Christmas trees he wants for anyone; he has to go.  Oh, and I'm

Affordable Housing Demands

The affordable housing industrial complex wants to take every town owned
property and give it to developers. STOP!

Sell the properties and let the money pay for town wide needs. I'm tired of
everything being focused on people's housing because they want to  live in a
place that they can't afford.

Please face the fact that we taxpayers are not here to do your bidding, to find
you jobs, to make the town a landlord for all of you to pay a portion of the
rent and the taxpayers pay the rest after buying land and giving it to
developers.

Enough is enough--just saying.

It appears that our Chairman of the  Board of Selectmen has changed his name
several times.  He now goes by the name of  "Austin Knight".  Is this presently
his heal name?  If it is not his legal name, and he is registered  to vote under
a  non-legal name, would this possibly be a federal crime? We need answers.

Library Director

 
Let's be clear. The post that stated that Sharon's buddy, Cheryl Napsha, has no
intention of leaving is pure B.S. If that was the case, why did she apply for
the Library Director's job in Yarmouth as soon as it became clear that Sharon
was bailing? Unfortunately for us, Yarmouth was too smart to hire her; she
didn't even make the first cut. Too bad Provincetown wasn't that smart. The
statements that she has an open door policy and that there are no staffing
problems are a joke. Spend a little time at the library and hopefully you'll see
what REALLY is going on over there.

Lastly (and I know you'll delete this, Clarence,but it is pretty funny!), if the
Finance Committee wants to trim fat from the budget,

we are free of her poor decision that did include how to handle Jeff Jaran.

It is so good that both of them are no longer in position of power. They may
still be here--and dining together before the great departure--but they no
longer have nor hold power here in town.

It is such a relief, such a gift.

I am not on the "candyland team" or any team for that matter. I am a citizen of
this town, just like you or anyone else and I'm as much entitled to express my
views on this blog as any other citizen of Provincetown. You can call my views
"attacks" and "misleading" if you like, that's your prerogative, but they are
just as valid as anyone else's. This "team" mentality is what's driving this
town apart. Our opinions may differ, but in the end we are all on the same team.
At least that's how things used to be before all this 'impeach everybody'
business.

Provincetown Public Library

Library Response

Wow, the library director sure told us, didn't she!
No problems, no worry, we should all shut up. Maybe
it wasn't the director, could have been the board member
who really pulls the strings from her full time home
somewhere in bum... Pennsylvania. 

No board meeting inOct. none in Dec. what happened to
November? Where isthe five year plan?  Why are there no kids
programs?

Wow, I'm happy for the people who had theire  books
published, but if that is all that the library has produced
since the director was installed it is pretty sad when you compare us to any
other cape library.

As far as just one person posting, well I've never posted
on this subject before so there must be at least one other
person with questions!

Oh yea, as far as the director having a "open" door...don't
make me laugh. She is locked in that office 8 hours a day.
Why are the two portholes covered with black fabric? Is it
to make napping easier?

Remember when we had a real director who never had a office
of her own? She was available to staff and customers alike.

So, keep up the defense of Ms Napsha while the rest of us
whisper the truth we all know. Napsha is napping while the library we know and
love just waits...for a real director.

some people have opinions that differ from your own? Are we putting a damper on

We did lose some wonderful people in 2013. Especially sad to experience Ciro
Cozzi's passing and then Patti Cozzi. they brought so much to this town and
shaped in generosity and constant giving.

Righting the Listing Ship

There are those of us who have expended great energy in exposing Mr.
Japan for what he was.  Ms. Lynn's incompetence was uncovered.  The Chief's
fledgling navy has been scuttled.  The goal has been achieve as the interlopers
are gone.  Enough already with recalls, etc.  Let the waters smooth themselves
and the good ship Provincetown will right itself once again.  I wish it and it's
citizens strong winds and calm seas as we sail into 2014.

Exhausting

How exhausting your life must be waiting decade after decade demaning and
conniving to get affordable housing! Year after year after year raililng against
fellow citizens who can pay their own way, who make their own comfortable life.

year after year complaing and making documentaries about houses being
built;railing against an economy where one has to work several service jobs--and
not really wanting a year round job.

Such an exhausting existence one would think.. How old are you know and how many
years have passed since you have been pushing this "cause"? so sad--and so true.

You're the one spreading the rumors, so all you need to do is stop posting
garbage and your wish will come true.
For those of us who actually use the library we are happy with almost
everything.  If something needs to change it is the children's area, which
should be somewhere quieter.
Otherwise things are good.  If you have concerns, you should address them to
people who can answer them: the BOS, the town manager, the library board, or the
staff.
No one on this blog can give you answers or feed your paranoia.  But I don't
think you're looking for answers, just for dirt.

Provincetown Banner - Austin Knight

Kudos to whoever wrote the editorial in this week's Banner. My
favorite quote: "The town needs leadership  its time for the board to
re-organize itself and focus on the job of running the town." This is exactly
what people around town have been saying for weeks! Enough with the finger
pointing, in-fighting and back stabbing. We elected our selectmen to run the
town, not fight amongst themselves like bratty little kids.

director, the director leaving, the trustees not getting along, and the refusal
of the director and trustees to meet for the last four months. Is the lid

There is nothing going on at the library except the board and staff serving the
community as usual.  All staff, including the director, communicate freely and
openly in person, in staff meetings, through email, and through written
communication.  Everyone is heard.  The director's office is on a different
floor from the circulation desk but her office door is usually open, and all
staff know they are always welcome.
The director is not leaving.  No board members are leaving or have left.  The
board gets along very well.  They did not meet in October because there wasn't a
quorum, and do not meet in December.  If you read the board minutes you'll see
that the board has a long list of projects and interests.
There is no 'lid' to blow off.
There are a few people who have made it their job to defame the library and its
staff for their own personal reasons.  If they get a life in the new year these
ridiculous, libelous posts may stop.  Until then, please notice that the
dramatic posts about the library have similar writing styles, from two separate
people.  They repeat the same lies over and over, hoping that they will be
believed.
It's very sad that these people do not have interests of their own but choose to
perpetuate the Provincetown agenda of destroying town employees and officials.

Tales told by an idiot full of sound and fury but significant of nothing, that's
all you spout.  It seems pretty simple.  If you spent half the time collecting
signatures as you do posting here, you'd already have submitted your affidavit
sworn by fifty registered voters and be well on your way to collecting the other
ten percent of registered voters.   But you won't do that will you?  You'll just
continue to post here making the town look bad and perpetuating the division.

By the way, what ever happened with the email scandal (Shhhh.. we're supposed to
stop asking about that).  Where is the evidence of miseeds and malfeasance that
were alluded to repeatedly on mypacc.   Maybe your still going over them and
that is why you havent had time to colect your fifty signatures.  Surely there
must be evidence therein to aid you in your get Austin smear campaign.  And
could you please provide us with a comprehensive list of the town employees who
you are going to go after next as alluded to in a previous post.  I'd like to be
prepared and sharpen my cutlery properly prior to the impending night of long
knives to come.

Austin may or may not have broken any laws but he has certainly not acted
professionally in his professional life as well as in his political activities. 
The man is obviously without scruples, and if people are willing to accept that
behaviour in elected officials then I guess Austin Knight deserves to continue
as Chairman of the Board of Selectmen. Before you champion this guy however,
remember he has been PROVEN TO BE UNETHICAL (although possibly not illegal).
Again, if that is what you want and expect in your elected officials then Austin

I am sure you are from the same camp that contually claimed Jaran would not be
fired. When His own police force turned against him was the pivotal moment many

Not only Jaran and sharon and austin, but a few of our key town employess. Again

flakes. How lucky to have such beauty among us. We now know what the essence of
Provincetown is--a rather quiet, if not silent, place here at the edge of the

I Think One Person Can be Recalled. See 10-1-1 "name"

Chapter 10

TERMINATION OF SERVICE
Section 1: Elected Officials

10-1-1 Any fifty registered voters of the town may file with the town clerk an
affidavit duly subscribed as to each signer by a person qualified to administer
oaths in the Commonwealth of Massachusetts, which affidavit shall contain the
name of the officer sought to be recalled and a complete enumeration of the
specific grounds for recall.
10-1-2 No recall petition shall be filed against an officer within three months
after he or she takes office, nor, in the case of an officer subjected to a
recall election and not recalled thereby, until at least six months after the
election at which his or her recall was submitted to the voters of the town has
elapsed.
10-1-3 The town clerk shall thereupon deliver to said voters making the
affidavit copies of petition blanks demanding such recall, copies of which
printed forms he or she shall keep available. The blanks shall be issued by the
town clerk with his or her signature and official seal attached thereto. They
shall be dated, shall be addressed to whom they are issued, the name or names of
the person or persons whose recall is sought, the grounds of the recall as
stated in the affidavit, and shall demand the election of the successor in the
said office. A copy of the petition shall be entered in a record book to be kept
in the office of the town clerk.
10-1-4 The recall petition shall be returned and filed with the town clerk
within twenty days after the filing of the affidavit, and shall have been signed
by at least ten percent of the registered voters of the town, who shall add to
their signatures the street and number, if any, of their residences.
10-1-5 The town clerk shall within twenty-four hours of receipt, submit the
petition to the registrars of voters of the town, and the registrars shall
forthwith certify thereon the number of signatures which are names of registered
voters of the town. If the petition shall be found and certified by the town
clerk to be sufficient, he or she shall submit the same with his or her
certificate to the selectmen without delay.
10-1-6 The selectmen shall forthwith give written notice of the receipt of the
certificate to the officer sought to be recalled and shall, if the officer does
not resign his office within five days thereafter, order an election to be held
on a date fixed by them not less than seventy-five or more than eighty-five days
after the date of the town clerk's certificate that a sufficient petition has
been filed; provided, however, that if any other town election is to occur
within one hundred days after the date of such certificate, the selectmen shall
postpone the holding of the recall election to the date of such other election.
If a vacancy occurs in such office after a recall election has been ordered, the
election shall nevertheless proceed as provided in this section. Candidates to
fill a vacancy shall be nominated in the same manner as for an annual
election.25

No Grounds For Recall

Generally speaking an elected person can be recalled for any reason,
but it is an abuse of the democratic election process to use the power of recall
for anything less than serious wrongdoing in the performance of the duties of
office. No one has been able to come up with any proof, or even a strong
suspicion, of this on the part of any selectman. They were all legally elected
and should serve out their terms unless there is a formal charge of wrongdoing
in office. Minor violations of campaign laws don't rise to this level and there
is very little likelihood that the signs at the police station had any real
influence on the election.  We can be sure that if it did there would be all
kinds of legal charges and investigations by the state. There have been NONE. 
IF AK tries to get reelected at the end of his present term,  I think that he
should not be elected.  We don't need his type in office, but it is still not
grounds for a recall.

Rewarding to see that someone knows facts here.  The Charter is our
version of a Constitution.  It is the law of the land in PT.  It is not new and
it would behoove all who are interested in town government to go to the tow web
site and download a copy of the charter.  It might help a lot of the
misinformation that is so common here.

You Can Recall Just One Person, In Fact, any One elected Official can
Individually Be Recalled

Read the Charter. Know our laws. Recall one person, any person and you can have
whatever reason you want to recall that person. You can find fault with their
rulings, with their positions, with their lack of leadership.

Look at Wellfleet. I think that there are now recalling two selectmen because
they are opposed to their votes on one key issue.

Since when can only one member of the Board of Selectmen be recalled?
the entire Board must be recalled!Then after they're recalled the ones you want
back have to be revoted & the ones being replaced have to campaign to be

and when did the change take place,if in fact.it did?

What makes no sense is your mention of Miami Beach. I read that posting and no
where in it did I read where Miami is mentioned. The comparison was between
Provincetown and south beach (a neighborhood in the city of Miami Beach).
Calling south beach "Miami Beach" would be like someone saying Provincetown is
Cape Cod.

Taking things out of context is like drinking Kool-Aid. You don't have any idea
what's in the packet that when added to water makes everything seem okay.

What I took away from reading that posting was how similar we are to south
beach, yet how we are not a year round destination. I'm a year-rounder and enjoy
the change of season, change of pace and change of people. But one thing is for
sure, and that is we are not a round-the-year place for tourists. And that's
okay; but we are what we are.

Perhaps if you read that posting again, you might formulate a different
impression.

We all hear people say that same sex marriage demeans traditional
opposite sex marriage.  We never hear how this occurs.

on the same level we hear that the election of AK was illegal, but never once
has anyone explained how the election violated the law,  It is probable that the
campaigns broke the law, but there is zero evidence that the election was
illegal.  So, if you want to push for a recall because the election was illegal,
come up with another reason, like you don't like him.  I didn't vote for AK and
never would, but I wouldn't vote for a recall unless i could be shown that he
had committed some wrong as an elected official in the performance of his
duties.

I think that's the biggest problem some are having with this business. A recall
should not be a common occurrence. It should be reserved for extreme

Each person is free to interpret morality and truth as that person sees fit.  So
AK really is OK with all that posters here said he did wrong because he thought
it was right. 

Snowden is free to what he thinks is right, and be ready to accept the consequences

because they think that their cause is just? 

How about people who kill abortion providers because they fervently believe that abortion
is wrong under any circumstances?  It is always a good idea to think through what you

The recall is not such a big overwhelming deal. You go forward, get the
signatures and have the special election. If it fails, and people vote again for
Austin, then let that be the choice of this town. It does not cost that much to
have the election. Let the votes be the votes without a Jeff Jaran intimidation
and others doing secret deals to get Austin elected. If town people vote for him
and want him in that seat, then so be it. If they don't, then he is gone and we
have a new face in that high horse seat.

large city like New York City or Miami Beach then I would live there.  However,

Just One Key Point: Edwin Snowden Did Not Act by Committee

He did not ask a group of people what they thought and did not ask a community

Reality: We Are Who We Are
 
A small town that became attractive to others. a small town that became rather
rich. a small town that has few second home owners living here at this time. a
small town that has few of us living here now or the next month or the following
month.

We are a tourist town with a four month go-go pizzazz and then a rather quiet
place with few people

I happen to love the silence but I also know that we are limited in what we can
do and should do. We remain a small town and should act accordingly.

Austin Knight Recall

While I fully support the idea of ousting AK from his position as not only chair
but also as a member of the BOS, I'll caution those that are trying for this
recall. It needs to be an overwhelming attack with big numbers of voters to
really show that the town is fed up with the corruption and flagrant voilation
of the laws. If it barely skims by and barely qualifies to make the recall
happen, it may backfire at the polls, costing the town quite a bit of money to
hold the recall election and many voters then would be angered by the recall
proponents, especially if it failed to happen and AK remined in office. Also
keep inmind, if the recall election fails to remve AK from his position, it only
makes him that much stronger and that could be very bad for the community and
any nay sayers that may come before him in the future. Be cafeful and make the
recall numbers impressive.

Provincetown as a "Tourist Destination"

Having joined other townies that spend their winters summering in south Florida,
I have to say SoBe (South Beach) has it all together. Using your credit card,
you can park on the street or in a parking structure, rent a bike from one kiosk
and drop it off at any other, walk on well-paved sidewalks throughout the
well-lit community, and enjoy food and libations from a diverse selection of
restaurants and cafes. Dogs are welcome everywhere. I was in Whole Foods today
and saw a woman with her dog shopping for biscuits. What a concept!

What's the biggest difference between here and home? The big hyphenated word
that defines why Provincetown will never be anything more than what it is.

You can SHOUT all you want but that won't make it true.  How was the election
not legit?  Your opinion, or legal fact?  Has anybody with legal authority over
elections declared it to be not legit?  Improper, illegal, unethical, immoral
campaign activities do not invalidate an election.  Legally proven ballot fraud
can, and will, make an election result be vacated.  So, like people have said
about guarantees,  get real and state facts, not just opinions.

We are Who We Are

We are not a year round business community. we re not an year round
entrepreneurial community. We are not what others may wish we were.

We are a tourist community and the season shrinks year by year.

We are not an industrial base. We are not a manufacturing base. We are a place

We are no more than that. And what do you want from us? We cannot be who we are
not.

We will not be a business enterprise that can generate a huge income. That is

could provide the needed space we need to take a deep breath, to just let all of
us settle in and give this town a small break. I hope he serves us well and with

A few have used the excuse of "Who else will you go after Austin?" as
the reason for giving Mr. Knight a free pass for his violations of election
laws.
IMHO, once Mr. Knight no longer is Selectman, that should be the end of it all. 
Some here have expressed their displeasure with a few town employees, but I
believe that once we get the Town Manager's position filled, those employees
will perform differently.  A big problem for us has been that Ms. Lynn was an
incompetent manager of people.  Example: Mr. Jaran  This guy maaaaaaybe could've
stood a chance with someone who kept him on tight leash.  She was either
unwilling, or unskilled to do this.  If anything, she commended him.  I think
with Mr. Garner now as the Acting Town Manager, we might see some improvements
in this area.  And whoever is the Town Manager, he/she must hear from the
community at large that effective hiring, management, training, support, and
evaluation of town employees is a top priority.  We must avoid another Mr. Jaran
being hired to work in this town.

And I hope that we concentrate on Mr. Knight ceasing to sit at the BOS table. I
don't know if a recall petition is circulating, but I'll be more than glad to
add my signature.  Mr. Knight is unfit to serve us.

Maybe you should Read the Police Union Rebuttal to the Marcum Report

Knight did break election rules and Jeff Jaran used the power of the police to
campaign for him. Austin was part of an unethical and illegal campaign and he
knew and even orchestrated this. there are also others who used their position
to get the weakest among us to vote for Austin. And then there was Elaine
Anderson who used her position as selectman and her role in the UU to send out
letters requesting these members vote for Austin Knight.

This man is a tragic reflection of the corruption of this town government. He
stands each time he sits (couldn't help with this) and reflects back to this
town how secret, illegal acts changed an election. And there is Jeff Jaran, as
per the police union rebuttal, stating that Jeff Jaran keep up this Mantra: Tom
Donegan is a police hater and Raphael Richter is a drug dealer. this mantra was
repeated over and over.

These are just some of the illegal acts that led Austin Knight to be elected. it
is a sickeninig process with too many town officials actively involve in these
corrupt acts.

No one is trying to "conflate" Austin Knights actions! All of the quasi legal,

The real issue at hand is the imoral and unetical actins of Austin in his day to

I've owned in town for twenty years, but I'm sorry, do I know you? I doubt it,
because you clearly do NOT know a thing about me. If you believe ANY of the
drivel contained in that first paragraph, then *I* believe that *you* don't care
enough about this town to even take the time to understand the issues. Instead,
you're lapping up the Kool-Aid that's being spoon-fed to you by the propaganda
machine. And that's a shame.

Isn't it ironic that you call us self-interested and ignorant, when in fact it
is your vision that is so myopically-focused on your own interests that you
can't seem to understand that "public interest" has nothing whatsoever to do
with wealth redistribution, and that "civility" is a word often used to stifle a
person's civil rights.

NEWSFLASH: If you think that Austin Knight stands to protect taxpayers, I pity
you for letting the fox watch the hen house. He is a con-man who has defrauded
clients of large sums of cash, so why wouldn't he do the same to taxpayers if he
had the chance? I bet he was salivating over those kickbacks he could have
received as gatekeeper to the chief's massive construction project... just
sayin'.

I disagree with the posting above.  The Jaran matter is much more
than just the signs:

1.  Violating the rights of an employee, which has resulted in a sexual
harrassment lawsuit that will cost us a chunk of $.
2.  Lying about one of his employees to a municipality, Chatham, which was
seeking to hire a police officer.
3.  Abusing his power by directing his staff to target citizens, eg., Squealing
Pig directing to ID and "run" patrons backgrounds.
4.  Unequal supervision and discipline of his staff
5.  Placing the signs inside a town building is one thing.  Even worse is his
talks with his department staff during working hours about three candidates, two
of which could sue for defamation.

One of these 5 issues is serious enough, add the other 4...and Jaran doesn't
stand a chance to win any arbitration, even the North Pole.

So you want to go with the ol' "nobody's perfect" claim? Fine.

When a person takes on a higher office, a leadership role, especially in a small
community, they are to set the example of how to conduct ones self in the face
of the laws and bylaws of the community.

AK knowingly violated the law numerous times and also got caught. You mention
laws regarding fishing and speeding and drinking. Most people do violate those
laws, cops too. But once caught, each person is required to suffer the consequences
by way of a fine, loss of license or some other consequence. AK never paid the
price for his violations.

He was caught without permits violating building codes set forth by the
commonwealth and the town while in office, he violated state and possibly federal
laws regarding sexual harrassment while in office and now he has violated state laws
regarding elections, one in which he was involved and "won" which enabled him to
stay in office.

Where are the penalties? Where are the fines? Where is the loss of his position in
the community? You make the claim he would have won the election? Nobody really
knows that factually.

How many people may have been influenced by the police supporting a particular
person? Don't know. You say get he facts if he has been unethical or dishonest
and get rid of him.

THAT'S WHT IS GOING ON RIGHT NOW!! The facts are there and they have been
proven to show he was wrong. And don't wait for the Ethic Commission to deal a
penalty to AK. It's all anonymous and we may never truly know the outcome.

The only way we will know is by AK himself and I wouldn't trust anything the says at
this point. He should save face for himself and the town and bow out now.

Just an Observation

Sigh...there sure are an awful lot of people posting on this blog
trying to conflate Austin Knight's business dealings, name change, etc. with the
issue at hand regarding distribution of campaign signs. Kind of reminds me of
how everyone tried to pin some sort of first amendment violation charge on Jaren
which was so ridiculous the Marcum report didn't even address it (although the
Banner continues to try to make some sort of issue about him "censoring" a
"classic" albeit profanity laced rap song) when the real issue was (again)
distribution of campaign signs.

A bit of advice: find a focus and stick with it. If you continue to muddy up the
waters and just hurl dozens of charges at your target, you aren't really doing
yourself any favors. You sound desperate, like you're grasping at straws. Just
an observation.

What I Always Wanted-not the Tiny House Movement

I grew up in a house with a basement and an attic. Storage space for things, all
8 kids shared rooms. We had a living room, dining room and a kitchen.

When I grew up--that is what I wanted too--and it is what I have. I can't
imagine developers building tiny houses and people salivating to live in them.

Summer things, Winter things, Christmas storage, places for your treasures, room
to breath so you and your partner aren't claustrophobic and incessantly together
with no place to put things or be alone.

If you want to live in Provincetown and live a life where you always feel that
you need to "settle" for what you can get and always feel deprived--it gets very
old after a while.

I see it every day--bitter people railing against their lot in life--a lot that
they chose. At some point you will wish for security, some comfort, some elbow
room. May you ultimately find it.

Proposed Police Station

There is a building committee consisting of serious minded, dedicated people who
have investigated every nuance of what is required and mandated by law in the
building of a new police station.

If you can go back and watch the building committee presentations, you will see
that they are being conscientious and their aim is to present to the architects
the most solid yet pared down police station possible for Provincetown.

As a concerned citizen who was initially against the police station out of
ignorance, I toured it and the DPW building and the building and grounds
building and they are a disgrace to the town.

At the time, men and women who worked for the town had only a port-a-potty to
use year round at the buildings and grounds building which is just a garage that
loses all of the heat when the garage doors need to be opened.

Perhaps if you had heard a female employee speak up at a meeting as I have, who
has had to use that port-a-potty, you might change you mind.

If all of the women in town had to use a port-a-potty for a week in this
weather--they might have some sympathy and want to bring that building WHICH HAS
NO RUNNING WATER into the 21st century.

larger pension, the manager claims she was only getting what the township had

A review of both early retirement agreements found that both managers received

for. Both also received pensions before they were of retirement age.

The township is suing former Township Manager Sharon Lynn to recoup $110,000 in
pension and sick pay benefits.

According to the township code, severance pay is only granted if a manager is
dismissed or resigns at the request of the board of supervisors.

I Know Nothing

So Austin Knight claims he knew nothing about jaran  getting

Here's What I Want. You Tell Me, Honestly

I have never read the Provincetown Voice page in Facebook. Nor do I
want cheap housing, or to get rid of everyone in town government.

Here's what I want.  You tell me, honestly, if I'm being unreasonable:

1.  I want a transparent and honest government.  This includes agendas for
meetings that include specifics, and when I'm told something is going to be
done, that it is done.  Otherwise, if not done as promised, give me a rationale
for why it wasn't done.  I don't want to be told lies, half-truths, or
platitudes.

2.  I want to know that if I have a concern, complaint or query, that it will be
fairly heard, and given serious consideration.

3.  I want to know that those that have little means will be treated in the same
fashion as those like me, who have considerable means.  Being treated in a
privileged way diminishes democracies.

4.  I want our paid town officials to be paid, and paid nicely. They work hard,
and I do appreciate what they do. What I don't appreciate is offering beginning
salaries, with follow-up increases that my little town can't sustain, as much as
I'd like to see these high salaries paid to our employees.  It all comes down to
what the market can bear.

5.  I want town facilities that are well-maintained, and that we can afford.
Thus, a 14-million dollar town building will never fly with me, unless it's pay

concerns had been disregarded by the Town Manager and the other 3 Selectmen.

How many times did we read here that it was only the same 4 or 5 people posting
and complaining here over and over?  The poor things were operating in such an
echo chamber that they truly were surprised when they saw how many were showing
up at Town Meeting, and Selectmen's meetings to attend, and even speak.  Meeting
rooms had to be changed because of the size of the public present.

And all of a sudden, those had been called "just the same 4 or 5" now were being
called "a mob". Truly desperate.

This corruption and disregard for the people of Provincetown has been going on
for several years, and we've had enough of it.  The TM's gravest mistake wasn't
to listen to the cabal.  It was to listen only to the cabal.  And by do doing so,
she removed herself more and more from the people she was supposed to work for. 

Rumors in Town Hall were that she was miserable.  Her last months were spent in
depositions (Jaran-related) and other litigations.  I'm thrilled she's leaving.

This time we need someone competent, who knows how to supervise subordinates, so
that another Jaran never gets hired and rewarded with high salaries and
long-term contracts.

We also need a TM who will give a fair hearing to those that bring complaints to
her.  Every single complaint about Jaran, which she refused to acknowledge, was
confirmed.

David Garner will have my full support.  I wish him well.  He seems like an
ethical and fair manager.

You want your cheap housing and your second homeowners to rent out their homes
in the winter so you can live there. You want the Provinctown taxpayers to buy
property and give it over to you to live in cheaply, you want the taxpayers to
buy land and build and pay for it and put it all on the back of the taxpayers so
you live here care free.

Your Mantra is: What is mine is mine and what is yours is MINE TOO! .You make
people in this town shudder. You make the PROVINCETOWN residents and voters
shudder.

Never have so many people who don't even live here been so vocal and keep
ripping apart the town. Keep going--the silent majority and not the ignorant

Incompetence vs Corruption

Some people seem to confuse incompetent with corrupt.  Sharon Lynn may
have been incompetent and her experience may have been totally inadequate to do
the job.  But, corrupt?

AK may be arrogant.  He might have done something illegal and pretty stupid with
the signs and police station.  But, is it worthy of so many posters frothing at
the mouth?  If there are truly some really serious faults here, let's hear the
specifics.  Dirty, silly politics that may be illegal, but not on the same par
as rigging the ballot box are less than good reasons to be so upset.

Musings for the day

1.  Do no like recalls. Not when talked about regarding the town moderator,
chair of finance committee, or newly elected selectman.  It is a last resort.  
We currently only have an investigative report and contradicting statements made
by the chair.  Until these are rolled into official indictments, sanctions, or
charges, they are allegations.
2.  Board of selectman elect their chair, so it is every bit their call to
decide person best suited to hold that position.  To do so does not thwart the
will of the voters.
3.   Think the step down from the board and step down from the chairmanship
arguments are being too confused on the various pages.
4. If nothing changes, Candidate forum first question, "Will you vote for Austin
Knight as chair?"
5. It is absurd that some are claiming that since the chair won by X number of
votes, that makes any election irregularities meaningless.   Illegal is illegal. 
Does not matter the outcome.

humble pie for christmas dinner?
9.  Town Manager left on her own accord.  Typical for that line of work is to
look for a larger city to manage every several years.  Move up the ladder. I do
not know her and do not know if that was her case.   She had support.  Had done
great things.  Unfortunately, her Achilles heel was the chief.  It is tragic
when one flaw becomes so great it casts a pall over fine work.
10. Taxes being paid and support at a Town Meeting allowed good things to
happen.
11.  Read up on the first amendment. Freedom of speech gets thrown around way
too frequently. It is about governmental action, not an administrator on a FB
page.

I believe Austin Knight is a very sick man. The BOS better serously

BOS would not listen to a good portion of the town before and now we are facing

History will look at these 3 as greedy, self serving and probably the worst BOS this
town has  ever seen. Oh and Elaine Anderson is digging herself deeper and deeper
into the abiss when she touts how wonderful Sharon Lynn is and was. She will
turn out to be the worst and most corrupt town manager in history. She has
intimidated and hurt so many people in this town. However, there is Karma.

As far as Elaine Anderson- most see her as a blind supporter of Sharon and nothing
more than a puppet and now she is becomming a joke. She turned her head to all
those in town that tried to convey something was so very wrong with our police dept.

Elaine Anderson is a digrace to keep up the same
facade. I hope she gets held accountable somewhere down the road in a legal
fashion. Her day will come. Karma.

PTV

What a joke, asking the BOS to directly receive funds using the reason that PTV
should not be invovled in politics.
The first board of directors was set up and chaired by Ann McGuire and has been
full of friends ever since.

It is time that a real membership be developed and the members vote for the
board.  Until then, PTV is a partisan political organization, hostile to input
that challenges them and  should not be given funding without any oversight. We
do not have a cable advisory board like other towns.  The treasurer is a
personal friend of the director of PTV.  This is an insular group that is
supposed to serve the town.

Why, after years of complaining, are there still audio problems? The town

Board to Consider Ouster of Fellow Selectman

Provincetown’s leaders set a date to vote on sacking their
chairman for his dealings with the fired police chief.

PROVINCETOWN – After emotional debate, fellow board members agreed Monday to consider removing Select­man Austin Knight as chairman at their Jan. 13 meeting.

Two selectmen, Tom Donegan and Erik Yingling, have now called on the chairman to resign or give up his lead­ership role over his alleged involve­ment with former Police Chief Jeff Jaran’s campaign violations. Jaran was fired last week for inappropriate behavior, including violating state and local law by campaigning for Knight’s re-election at staff meetings in April.

Knight said he had no idea his signs went to police. But an independent investigation of Jaran’s behavior stated “it appears clear that Mr. Knight knew that the signs would be distributed to Provincetown Police Officers.”

Knight has refused to resign.

On Monday, many residents rose to defend him and called on the select­men to stop infighting.

Many others supported Donegan and Yingling in urging Knight to step aside so the town can move forward after months of controversy related to Jaran.

“I’ve voted for every single one of you,” said Marion Roth, a resident. “I thought you would be good select­men.”

But rather than deal with very real issues facing the town, she said, the selectmen are arguing about signs.

“Get over it,” she said. “Treat each other with dignity.”

“I find it sort of funny, and not in a ha-ha way, that I’m defending one of the finest selectmen we have ever had,” said resident Judith Cicero.

Others argued that Knight shouldn’t resign because it violates the town charter.

The electoral process requires a recall election requested by 10 percent of registered voters via petition, said Julia Perry, a member of the charter enforcement commission who said she was speaking Monday as a private citizen.

A recall petition is circulating.

Resident Ngina Lythcott said the cur­rent negativity that may have caused Town Manager Sharon Lynn to resign is creeping like bad water.

“We’re creating an environment where no one good is going to want to work here,”Lythcott said.

But others countered that campaign violations aren’t minor mistakes.

“It saddens me to say this because I like Austin Knight,” said resident Barbara Rushmore.“But I’ve read the report and I know things about you (Knight) that haven’t been made pub­lic. I think you’ve broken the law and I think you know it.”

Dieter Groll, a resident, pointed out inconsistencies with Knight’s state­ments and findings by independent investigator Frank Rudewicz that Knight did know the campaign signs were going to police.

Knight was clear on his position.

“I will not resign,”he said.

About 673 people elected him, he said, and they expect him to continue to work.

Yingling said Knight should resign but he understands it’s up to voters to recall him.Yingling then made a motion to“rescind Austin’s chairmanship.”

“It’s not just nitpicking or being mean,”Yingling said.“Town resources were deployed for his campaign, so essentially we didn’t have a free and fair election.”

Town Counsel John Giorgio advised selectmen they could make the vote to rescind. But it was not an agenda item, so they could be in violation of open meeting law.

The board chairman, Giorgio said, could make the call to hold the vote anyway, but it might not hold up to scrutiny with the attorney general.

Selectmen ultimately agreed to take a Jan. 13 vote to possibly unseat Knight.

As emotional and personal as the subject was, selectmen remained polite.

WhenYingling was finished arguing for Knight’s removal, Knight calmly askedYingling if he had anything else to say during selectmen’s statements.

“I want to wish everyone a Merry Christmas,”Yingling replied.

Jaran Payout

Thanks to our TM, we've givinen Jeff over $30,000 without doing any
work.  She could have suspended him pay for the first 15 days, and then without
pay for day 16 on.  That's what we legally were required to do.

And some people are saying that we should with him for a big chunk of money? 
We'll be already paying to settle the sexual harrassment lawsuit, which was a
result of Jeff and the TM.  Now we have to pay this guy????

I say not a penny, and see you in court.

In fact, he should be forced to pay all of the legal costs incurred in the
Poulin case, plus anything else we have to pay due to his crazy behavior.

We're in this situation with Jaran now because Sharon "investigated"
several police abuse incidents, and found nothing wrong with Jaran.

Many in the community were aware and had complained about police matters, all
pointing at Jaran, and once theindependent investigation was concluded, not only

I can't condone what Jaran or Knight did.

Both must go.  We didn't do these things.  THEY did!

Who Knew?

Just reading this week's Banner - it's amazing how different the
overall tone is when another reporter is given some space - and all I can say

Provincetown police chief fired

PROVINCETOWN  Provincetowns police chief was fired Wednesday after being accused
of urging members of the department to support a particular candidate for the
select board and for taking down the names of customers at a bar after a song
with anti-police lyrics was played.

Jeff Jaran, chief since 2008, was fired following a closed-door meeting with
selectmen that lasted more than three hours.

Jarans attorney told the Cape Cod Times his client will dispute the termination
at an arbitration hearing where he expects full vindication.

An independent investigator determined that Jaran violated local and state laws
when he held staff meetings at which he discussed the need to support a
particular political candidate.

The investigator also found that it was unnecessary to collect names at the
bar."

Tots drive. Says a lot about a towns population on one hand but it says even
more when a town is so divided over the police department and the citizens come
out like they did to support the cause through their police department. Very

Let Him Leave Now

We'd all be better off if Jeff Jaran's case was closed and this done today. If
we could bring this to a fast finish, we would all be better for this. For this
case to drag on and on--and it will--if we do not try to resolve this now, then
there will be no peace and no closure and  no healing for months to a years.

Let us do what is right for the town--close this case out. I fail to understand
those selectmen who don't understand the greater good that doing this would do.

Let's resolve this and bring closure. Then we can begin the year anew. It's what
we need now.

What Is Missed by Some

The lack of leadership by the town manager and the BOS has consequences.
It also means some who were hired should not have been hired. It means a lack of
management and individuals working for this town who are not really working for
us--but for themselves. We do have a mess at town hall and it will take Sharon
leaving--which is soon to do--and Jeff Jaran leaving--which is now an ex-chief.
and then time for things to settle in and for us to see clearly who is doing
competent work and who is dedicated to the town and those who are not.

If Sharon Hired 70% of those who are heads of departments, then there are
questions to be asked. If questions are raised about some, there are issues that
need attention and identifying those who are incompetent or even worse,
self-serving, then so be it!

Correction: No One Wants to Get Rid of the Library Staff

We want to get rid of the library director.  It's all connected: Sharon Lynn, Jeff Jaran,
Bob Klytta, Evelyn "Lynn" Kratz, Cheryl Napsha, Ann Maguire, Dan Hoort, 
individuals on the PTV board, library trustees.  There are several others.  We
are fed up by the personal friends of Sharon Lynn who have special access to
power and information and have been given special consideration and
appointments. They have treated other townsfolk with disdain and exclusion, as
Sharon Lynn expects and does herself.  It is not random troublemaking that is
targeting people and groups. It is the consequence of all Sharon Lynn's "plants"
and special friends who have been systematically poisoning this town over the
past few years. Many good people have been damaged. We see this most obviously
in the case of Andrea Poulin, but many others have been similarly humiliated,
forced out of jobs and town boards, lied to and manipulated f!
or selfish gain and power. This--in our tiny beautiful precious community--will
be stood for no more and we need to keep communicating in order to purge our
community of powerful outsiders who don't have a real clue about the spirit and
history of Provincetown.

deserve a big THANK YOU...  What a great event it was on this snowy, cold winter

His attorney claims Jaran will be vindicated at the arbitration hearing. That
very well may be, but notice there was no mention by this attorney about Jaran
getting his job back.

Vindication is merely a defense, an excuse, such as: "poverty was a vindication

Quite frankly, Elaine Anderson should put a stop to this nonsence. "It's time to
move on," were her words.

Who cares about excuses? Jaran has been terminated. He's done. We're done.

If You Request Public Documents

and they are not given, either entirely held back or redacted, for each document
requested, as here each exhibit, the holders of the documents must provide a
specific exemption for each document. they cannot legally give a general
exemption to cover all the documents requested.

It seems that this town regularly holds back public documents and then only
gives a general reason with a general exemption for all the documents requested.
this is improper and wrong. and if Kopelman & Paige are providing this type of
advice to the town--and are writing the letters covering the exemptions--then
there is even more reason to question this firm and its legal advice, not to
mention their bills.

Isn't this the same law firm that allowed Jeff Jaran's contract to be accepted
even as it contradicts the charter of Provincetown?

And Then There Were Non

First they came for the Board of Selecmen.   I wasn't one of them so I
said nothing.  Then they came for the Town Manager and Police Chief.  I didn't

again I said nothing.  Now they are coming for the staff of PTV.   I figure I

Seriously,  you need to put aside your grudges and start working toward healing
the wounds inflicted on this town.  The question has been raised and I concur, 
who in their right mind would want to work for this town or volunteer if what
they get in return is the slings and arrows of hate and derision slung about by
a few internet trolls on this board.

I am not on anybody's side except the town's.  I already see things differently
than I used too.  I used to look at town where people were nice and got along
with a live and let live attitude.  After a few years of reading this board, I
along with other people I know view things a little differently.  The niceness
is just a thin veneer beneath which lies an ocean of bile, resentment and
bitteness toward those who step forward too make a difference.

A previous poster asked this and I agree where is this going.Who's next the
people who work at the dump.


In closing, I ask you to consider the town and its reputation before you make
your next post and before you zero in on your next group of victims.   Before

So, lets see. The treasurer came to the selectmen 2-3 weeks ago  with beth and
said , hey lets get the cash sent right to PTV instead of going to Town Meeting
for a vote. Why? He said "so the politics are taken out of it". well. lets take

Please accept this letter as a response to Mr. Walker’s public records request, dated December 3, 2013, in which he requests the exhibits to the Marcum Report.

Please be advised that the Town is unable to allow your request for copies of the requested records at this time, since said documents are exempt from disclosure under the Public Records Law. The reasons for the Town’s decision are as follows:

 

Exemptions (a) and (c) of the Public Records Law (G.L. c. 4, §7(26)), permit a records custodian to withhold records the disclosure of which may constitute an unwarranted invasion of personal privacy. Under Exemption (a), records that are “specifically or by necessary implication exempted from disclosure by statute” may be withheld from disclosure. G.L. c. 4, §7(26)(a). Exemption (a) has been interpreted to mean that requested materials may be withheld where the language of the statute of exemption relied upon expressly states or necessarily implies that the public’s right to inspect records under the Public Records Law is restricted. The provisions of G.L. c. 214, §1B and G.L. c. 268A permit withholding of responsive records through operation of exemption (a) in this instance. This statute affords individuals a right against the unreasonable, substantial or serious interference with their privacy.

Exemption (c) of the Public Records Law (G.L. c. 4, §7(26)), permits a records custodian to withhold records that are:

Personnel and medical files or information; also any other materials or data relating to a specifically named individual, the disclosure of which may constitute an unwarranted invasion of personal privacy.

There are two clauses to exemption (c). The first clause of exemption (c) allows a municipality to withhold records of a private personal nature, including records which reflect medical information regarding a specific individual, and “personnel records.” Like exemption (a), the second clause of exemption (c) operates to protect personal privacy interests. Thus, records that are being withheld pursuant to G.L. c. 214, §1B through operation of exemption (a), as noted above, are similarly being withheld from disclosure under the second clause of exemption (c).
 

Please be advised that Pursuant to 950 CMR 32.08, Mr. Walker may appeal this response to the Supervisor of Public Records within 90 days. Thank you for your attention.

Are you for real?  PTV is exactly s it is supposed to be public access for real
people mostly volunteering their time.  If you think you are going to get
professional tv directors producers and technical staff volunteer to broadcast
the BOS meetings I'd like to know what you're smoking.

Here's an idea.  If you have a problem with the camera position or sound quality
on the TV, get off your *&^ and attend the meetings in person.  If you then have
trouble hearing you may then ask under a point of personal priveledge for the
speaker to speak up!  You will also be free to focus your gaze in which ever
direction you choose!   Remember it's better to light a single candle than to
sit and curse the darkness.

Guarantees vs Opinions

For some reason there is confusion about the attitude displayed by
folks who "guarantee" outcomes vs someone who asks about the meaning of the
"guarantee".  Maybe it's simply a use of a word, sorta like "awesome" and
"Amazing".  meanings change and words tend to get dumbed down and lose force. 
You can be convinced that AK would be recalled, but, think about it, you can't
guarantee it.  I see a bit of the same arrogance when people would like their
opinions to matter more than they really do.  They then refer to their opinion
as being held by "most people".  Of course they don't know "most people" and
haven't even done a legitimate survey.  But, it sure makes one feel like they
have a more secure argument when they claim to share the opinion of the vast
majority.  Dream on.  Let us know when you'll be standing at the S&S with the
recall petition.  We may even sign it.

Re: Christmas Concert

To answer your question about the preschool/daycare in the christmas
concert.  This is just a guess but I imagine the reason is that the
kids in preschool ate NOT provincetown students.

It is a grant funded program with high tuition.
Anyone who either can afford it or gets section 8 can go there.
We have people from as far away as Eastham who send their kids here to daycare.
Again, not our students.

Winter Concert:

I was present at the winter concert last night at the school.  I thought it was
well done.....  The only dis appointment I had was the fact that the pre school
children sang their two songs and when it came to the finale, they were
excluded.  The closing songs are what everyone looks forward to even the
children...

So can anyone explain why they did not get to participate in Frosty the Snowman,
Rudolph the Red Nose Reindeer ?

the decision. So what would they do.  Just saying that we'll have to pay for
lawyers is not exactly a foundation for deciding whether to do the right thing
or not.

Renewal and Relief

I feel such renewed hope that we are at last making the kinds of
changes we have long needed to restore our town and humanity. The reign of the
police state in our town is finally coming to an end.

Let's make good choices that are well vetted for the next hiring for these
positions. EMPLOYMENT AT WILL contracts only. Almost everyone in the country
works without a guaranty and our town officials should be accountable and held
to a high standard.

There is still some cleaning up to do on the police force and hopeful this too
can be accomplished. Very proud of the police union and officers that spoke up
and did the right thing. Pre-employment psychological & personality screening
assessments should also be required of the next candidates for chief and town
manager.

I too was disappointed that PTV did not record the 7:30 meeting
regarding Jaran but that is because it was a closed meeting. However, I agree
about the bad camera work PTV does. Sometimes a board member is talking and they
do not even have the camera on the right person and it is also too distant of a
shot. And why is there a problem with the volume. I always have to turn it up to
hear. Very unprofessional!

So can someone tell me the relationship that you all have been talking about
between Russell Braun and Gloria?
I have gone back pretty far on this blog and only see that there is one?   How
did he know her?   For how long?  (but even if they knew each other in prior
jobs, does that really make her Russells puppet?)  Braun was never ever a
building inspector.   he was a builder of condos in Western MA with a partner
who had most of the money, he was an architect and when he got the job in
Provincetown, he had to go to some sort of classes to become an inspector.  He
only knows how to build buildings in his past life before Provincetown.  He also
built 3 homes in Truro before becoming to Provincetown and actually I believe
was out of work when he got the job in town.

SO, how does he and Gloria have a relationship?

According to the Banner, six members of the police department were called by
Klein to testify against Jaran Wednesday night. Six bullets are in Jaran's gun,
which was issued by the town.

I hope both his gun and town-issued vehicle have been surrendered.

Pride Goeth Before a Fall

Drinking in the town you are police chief, getting drunk in public,
and constantly hitting on the female staff where you are drinking.  Standard
Jeff Jaran policy. Well before any of the other issues came up, his behavior
around town was poor and not setting the example of chief of police. Illegal no.
Violating his contract no. But hey if your borderline harassing hospitality
staff as police chief off duty , is anyone surprised he then backed a male
police officer over a long term female police officer regarding sexual
harassment on the job?

It comes as no surprise that his Kingly behavior around town as well crossed the
line at The Pig, and with electioneering from Police HQ.

Hey Jeff, when you hooked up out on the town, were the gals              in front
of you, or                                                                                                ?
You were with some of the bigger party girls in town, and that's saying a lot.

The town of Chatham had so many issues with off duty officers drinking in local
Chatham establishments, they made an in writing clause to prevent issues. Maybe
that's needed for the Chief in P'town at least, sheesh. At least be discreet
buddy.

A police chief is supposed to lead by example. Not intimidate, not cover up
sexual harassment, not break election laws, not hang with members of the
opposite sex with blatant and well known                                 , not pester

Jaran Knew the Jig Was up

if Jaran believed he had been falsely accused, bullied by social media and
always conducted himself in a way he felt was right, I would expect him to stand
his ground and fight 100% confident he would be vindicated and return to work
head held high. But he didn't - he put his house on the market a couple of days
after he was suspended. If he was confident that he was going to feel vindicated
why run? He knew all along he had been caught and had done things that would
lead to where we are today. Now he is appealing? Ok go through the formality but

Provincetown police chief fired following
disciplinary hearing

Following months of controversy and public calls for his resignation,
Provincetown Police Chief Jeff Jarans contract with the town was terminated by
Town Manager Sharon Lynn at a hearing Wednesday night, more than two years
before it was set to expire in May 2016.

This result at this level was expected, Andrew Gambaccini, Jarans attorney said,
adding that the chief looks forward to full vindication at arbitration.

According to his contract, Jaran may appeal the decision to a committee of
arbitrators consisting of a person chosen by him, a person chosen by the town,
and a person chosen by both of them. That committee may reverse the decision. If
it doesnt, Jaran can bring the case to a committee of arbitrators in Boston or
to Orleans District Court or Barnstable Superior Court, any of which could also
reverse the decision. If it does, the chief is entitled to back pay, benefits
and counsel fees.

The board of selectmen, along with Town Manager Sharon Lynn and town counsel
Darren Klein of Kopelman & Paige, met with Jaran and his attorney behind shut
doors for three-and-a-half hours before the decision was announced.

Six members of the police department were called by Klein to testify against
Jaran Wednesday night. Jaran was suspended by the town manager with pay since
Sept. 12, when the police unions issued a vote of no confidence in the chief. He
earned more than $31,000 during his nearly 13-week suspension.

The executive session hearing, during which, according to the agenda, selectmen
met to discuss the discipline or dismissal of, or complaints or charges against,
a public officer, employee, staff member or individual, was scheduled following
the Nov. 25 release of the Marcum Report, an independent investigation that
chronicled Jarans allegedly untoward behavior.

In that report, it was concluded that the chief violated state and town laws
when he held at least two meetings during which he urged sworn, on-duty police
officers to vote for Austin Knight and, further, distributed selectmen chair
Austin Knights campaign signs from the police station.

On Monday evening, Meredith Kurkjian Lobur, president of the Provincetown Police
Labor Federation and New England Police Benevolent Association, told selectmen
that the Marcum Report contained inaccuracies and did not go far enough in its
fault finding of the police chief.

Jaran repeatedly told officers that, [Raphael] Richter is a drug dealer and
[Tom] Donegan hates cops, Lobur wrote in the Union Response to Report of Marcum
Advisory Group. Both Richter and Donegan ran for selectmen in the May 7 race
against Knight.

The chief left Knights signs in a room near the door of the police station,
where cops exit multiple times a day, for at least two weeks, the union report
stated, adding that the signs were provided by Knight and that Knight knew they
were being distributed from there. Knight denied that on Monday night.

She further wrote that Jaran claimed he was a victim of a hate crime back in
May, after a classic NWA song that is critical of police played at The Squealing
Pig restaurant-bar while he was having drinks with friends, and that he
inappropriately subsequently directed detectives to investigate the incident,
though that never happened.

Donegan, who has long recused himself from matters concerning illegal campaign
issues, and Knight, who recently recused himself from police matters after being
advised to do so by town counsel, were both absent from the hearing. Selectman
Elaine Anderson, David McChesney and Erik Yingling were in attendence.

right before Holly Folly.

I've always had problems with decorations for a holiday representing only one
religious faith on any government building, so I appreciate not having the

PROVINCETOWN  Police Chief Jeff Jaran is now the former chief after the town
manager fired him following a closed-door meeting with selectmen that lasted
more than three hours on Wednesday night.

The result at this level was expected, said Andrew Gambaccini, Jarans attorney.

Jaran will dispute the termination at an arbitration hearing where he expects
full vindication, the attorney added. The former chief would not comment.

The selectmen ratified the town managers decision, they said after emerging from
the closed-door session.

Its very difficult, but there was just an overwhelming amount of evidence, said
Selectman Erik Yingling.

We hope this will allow the town to move forward, added Selectman Elaine
Anderson.

The arbitration committee will be made up of three people, one selected by
Provincetown officials, one selected by the chief and one that both parties
choose in agreement, according to Jarans contract. A majority vote is needed to
reverse the disciplinary action.

Jaran has been the subject of much public scrutiny ever since the May 7 election
and following his angry reaction to a N.W.A song with anti-police lyrics played
at The Squealing Pig pub.

Town Manager Sharon Lynn and the selectmen hired Jaran in 2008 from Bow, N.H.,
where he had been the police chief for four years.

Jaran has three years left on a five-year contract. He was paid about $127,000
in 2013, according to the contract.

Lynn suspended him on Sept. 12 after the police union issued a no-confidence
vote in their chief. The union charged him with trying to get staff to vote for
Selectman Austin Knight, as well as other inappropriate behavior.

Selectmen hired an independent investigator, Frank Rudewicz of Marcum LLP to
look into the unions complaints as well as the incident at The Squealing Pig.

Rudewiczs report, released on Nov. 25, found that Jaran violated local and state
laws when he held staff meetings in April, prior to the May 7 election, at which
he discussed the need to support Knight.

The report also stated that the chief told Lt. James Golden to pick up campaign
signs for Knight and bring them to the station. The chief had them in the
station for employees who wanted to take them, Rudewicz said.

Golden, who felt uncomfortable doing this, changed into plainclothes and used
his own car to carry out the directive, the report noted.

Rudewicz also found that Jaran did not behave violently at the Squealing Pig,
but patrons were intimidated.

Afterward, he unnecessarily directed officers to collect names of the people in
the bar that night, the report found.

The police union president, Detective Meredith Lobur, on Monday criticized
Rudewiczs report, saying that staff did feel uncomfortable and pressured by at
least one of these conversations about Knight.

Rudewicz report had stated that paranoia and mistrust has permeated the town.
The issues that occurred over seven months ago could have been addressed much
earlier individually, he reported.

But because of the mistrust, the incidents festered, allowing rumor and innuendo
to mix with facts that negatively impacted the Provincetown community, Rudewicz
wrote.

Lobur, in her letter of response, wrote it wasnt paranoia that caused Jarans
angry reaction to a 20-plus-year-old rap song.

Nor did it commit ethical violations in campaignin, she wrote.

The issues investigated by Rudewicz fall squarely on the chief of police, Lobur
wrote.

Goings On at the Building Department

It appears that there is a concerted effort by the Building Commissioner, Russel Braun,
to oust Maxine Notaro from her  responsibilities and/or job at the building
department.  Why is this going on?  Is it because Maxine knows too much about

How does making money in the real estate market disqualify you from

Lobur and Steele Were Courageous

Their letter in September delineated charges which were ignored by the BOS and the TM.

I remember watching people approach the mike and say to the BOS that they wanted
all the charges made investigated. Eileen saying: "U don't understand why you

her head with puzzlement.

Guess what - The people were right, and you lied to us.  Joy didn't investigate
what you promised.  This isn't a matter of interpretation. You, the TM and the
BOS went on record lying to the residents.

BOS Accountability

My call is we should hold The BOS accountable for voting on the
ironclad contracts of town employees namely Jeff Jaran and more importantly the
law suits that the town will face due to their lack of accountablility.  I say
Elaine Anderson, Austin Knight and David McChesney should be held accountable.
When the public addressed them over and over since May at various BOS meetings
the three of them "turned their cheeks". The only two who were willing to vote
and or found credibility in the Provincetown people were Tom Donegan and Erik
Yingling.   Elaine Anderson acted in some instances with a voice of repulsion
and in many cases was even sarcastic in reaction to the public's outcry.  Go to
Ptowntv and view the meetings since the Beginning of June. This is an outrage
and these three should and will be held accountable.

Why didn't Marcum interview the Police staff in person?  Brief telephone
interviews????  And 4 of them weren't interviewed at all, even though they'd
said they'd all be interviewed.

And the capricious inconsistent disciplinary actions from Jaran towards his
staff.  Why wasn't that part if the investigation?  Lynn and the BOS said all if
the allegations in the Police Union letter would've included.  And I like a fool
believed them!!! I'm sick and tired of all these cover ups, lies and half
truths.  Need to do some house cleaning.  The Pier Corp already did it.  We

Sharon Lynn Day?????

Before December 20, she should writing a personal check to the taxpayers for all
of the tax dollars we've spent on correcting her inept actions, including legal
fees, confidential settlements, investigations, etc., etc.  And on top of this,
we were paying $140,000 a year for Sharon Lynn's incompetence.  I wonder if we
could sue her and Jaran in order to recover the costs we've incurred because of
them.

I thought the investigators were quite thorough, and the report was
professional.

I do have 2 points in the report that need clarification:

1.  Bottom line on the Squealing Pig incident:
Did Jaran violate the oath he took when he was appointed as our chief, violate
his contract with us, or do something unbecoming for the individual holding the
highest office in our town's Police Department.  I appreciate that the staff
from the establishment forgave Jaran. That's all sweet at the personal level. 
But it'd be like the San Diego Mayor apologizing to the women he sexually
harassed, and the women accepting the apology.  If there was wrongdoing by the
Mayor, then the forgiveness by the victims, is sweet, but at the end of the day,
irrelevant.  The City of San Diego needed to pursue whether its Mayor was still
the person to lead it, considering the sexual harassment accusations.

2.  A statement was made regarding the Police Union's letter
Why did the Marcum Report label this letter as "opportunistic"?  The Report
should have elaborated this conclusion.

Other than the above, I think they did a great job.  Now it's up to us to do
what's right for our town.  Two actions must be implemented stemming from the
report's findings.

To briefly summarize there are those who didn't like the Marcum report so they
are working to re-write the story.  This includes the police union who want one
of their own to be police chief.  The police union who mentions the assault on
one of their members, but fails to mention that it was one of their members who
committed the assault.  Small fact to ignore wouldn't you say?

Then you have a group of people who six months ago were claiming this terrible
police department was creating a police state.  Once the police union turned on
Chief Jaran they have all of a sudden become the best police force ever!  In
spite of no one ever saying that Chief Jaran ordered them to intimidate and
create fear among private citizens.  So Chief Jaran didn't create this alleged
police state, but when he's not around they all of a sudden have become little
angels and everyone loves them.

Rehobeth Beach Wouldn't Be Happy With Last Night's BOS Meeting

Handled the police issue? Issued an investigation? Had findings that were great?
Resolved the police problem in Provincetown?

Really? That at will contract could be the shortest ever! If the present City
Manager of Rehobeth Beach lasted 30 years---Sharon Lynn could last three months!
Or three weeks!

Things are not going well and then there's Wednesday and the disciplinary
meeting: Will she mess this up as well? Will she let Jeff Jaran back? If he's
back......Rehobeth Beach will surely be informed about the dissent, if not
rebellion, by the police and by many here in town.

..not the BOS, that seems to be so silent about all key issues. Except for Austin
Knight to call for Sharon Lynn Day on December 18th. Is that what they have a
voice for? Let her go and go gently into night! We'll dance when she is gone.

But back to the Police Union who courageously took issue with so many wrong

   Disparate community groups did not repeatedly act in violation of the Union
contract.

    A "bunker mentality" did not sexually assault a female member of the
department, harass her and then lie to obtain a law enforcement job for her
assailant....

     The Union asserts and avers that the issues enumerated in our letter of
September 12, 2013 and those that were the subject of the Marcum investigation
fall squarely on the Chief of Police."

     You have made us proud. thank you for standing up and standing for all of
us.

The Marcum organization was selected to do the investigation.  The
time to critique their reputation and their ability was when they were being
selected.  The report is the report.  Use it as is, and move on.  So what if
some people don't like some, or all, of the findings.  And, DO NOT allow the
police union to attach their additional reports.  Doing so will only open the
door to allowing every nutbag in town to then have to attach their own addendum,
as well as the witnesses, and the subjects, and everyone else.  Stay the course. 
Use the report.  Who cares if some employees (cops) don't like that their boss
isn't disparaged enough.

The cops work for the town.  They shouldn't get to pick their boss.  They sound
like a bunch of cry babies.

Completely correct unless there is a question of legality to the contract and
then labor counsel is asked on it's legality. The final decision, one of whether
or not the contract is fair to both the employee and the town is up to the
selectmen. The costs are then approved in a huge number at town meeting, blended
together with all other raises and somewhat hidden from the general public
although it's right there under their noses. The general public doesn't know
where to look. By the time of town meeting, the contract has already been
awarded and the employee is usually already working so the money is found for
the contract somewhere anyway. Otherwise, the town would be sued for failure to
produce their end of the agreement. Nice huh?
It's all up to the selectmen.

laugh.  he made the comment the signs were left in" HIS ' garage, thats pretty
funny last time i checked he didn't own a garage , a matter of fact he owns

this narcissistic attitude and thinks he is not going to not be held
accountable.  I say u most certainly did know the signs were being distributed

This is widely known.  It's also widely known that our policy makers hardly ever
act contrary to our lawyers' advice.  I thought Canizales' point is an excellent
one.  We need to review possible alternatives of our current law firm we've
employed.  The monetary and employment terms in the contracts the BOS has
approved have made me wonder if town counsel was taking a nap.

I also agree with Canizales on the "free at will" contractual term.

Also, we have to find a way to stop future Sharon Lynn's from renewing contracts
for employees that have pending litigation cases against them.  She pulled a
fast one when she renewed the Police Chief's contract.  The same with the BOS. 
They deliberately renewed Lynn's contract while all of the complaints that had
been raised against her, and even went on record (Elaine and David) on lauding
her.  Most of us in town were shaking our heads in disbelief when we learned of
this.

The BOS is Boss!

I think that maybe that it would be wise to check on who has the
authority to sign employment contracts.  Highly unlikely that TM has any say in
the matter.  Fincom has none according to the charter.  Seems to be 100% the
BOS.

Without a contract there would be very few competent candidates for the manager
job.  I checked across the state on town sites and see that these people have a
very short shelf life and always seem to have people who want to run them out of
town.  There is always someone who wants them to do their bidding, and when they
don't they start a fire the manager campaign.

This is not a judgement of Lynn.  She certainly has her major flaws that put her
job in jeopardy.  All managers are in danger of developing enemies real fast if
they ever do anything.  The only examples of longevity are where the manager
does as little as possible that could be considered controversial.  Find out
what the boss (the BOS) wants and give it to them.  If you make waves you'll be
capsized and drown.

Wow!! if we are not in the RED now, Provincetown will be there real soon with
this DREAM TEAM. Yingling and Anderson concerned about a 4% rent increase after
18 mos.

They have to be kidding or they never had to rent. What planet does Donegan
live on? Must be Mars, lets revisit this increase in a year.


Everything goes up in price including rent, that is why you don't live in a
place that you can't afford to live. People with a half a brain realize that
rents usually go up not down.

It took me 56 years until I could afford to get a small place in Provincetown.

I was a renter and could not live in the desired neighborhoods. Why? because we
could not afford it. We also had junker cars, never a late model and certainly
not a new one.  Take a peek at the parking lot of province landing. Not to
shabby.


When I had a noise complaint, the answer was always the same. If you don't like
it move. So we moved, we were not ENTITLED to live in those high end
neighborhoods..No one ever came to sound proof our apartment.

May I suggest:


The          family as we all know is a big money family, that already owns a
huge part of PTOWN.  They're certainly not a part of the 99 percent.  Maybe they
should donate $12,481 back the  people at province landing, so they would not
have to endure that 4% increase.

Employment Contracts - Mike Canizales


My recommendation to you and to Town Meeting and Finance Committee will be to eliminate Employment Contracts for the TM and Chief and to replace them with Employment at Will Agreements. That’s what the market expects now and that’s what we should be doing. I’ll further  be recommending we get Special Counsel for the new Agreements. No matter what one thinks of K&P, it cannot be argued with any credibility that they served the town by allowing these past contracts to be issued.  My understanding is these deals need to be ratified by Town Meeting. I am quite certain our insurance company would agree with me.  I think it would be outstanding if Personnel, Fincom and the BOS could recommend them unanimously, after vigorous debate, to Town Meeting.

What Will Come Next?

Sharon got her new job in a few months. Bergman took YEARS!That says
an awful lot. Sharon made some mistakes but she is a competent professional.
Rehobeth is lucky to get her.I now dread the puppet that we will be stuck with

or Anderson are replaced so they can pick some nitwit that will put up with
their inept meddling and control. And lets see if after all the complaining
about the TM's salary if we hire someone for far less.. I doubt it!

Sharon Lynn -BOS All Theatre

I have the feeling that she has portrayed herself, erroneously, and by
design, to Rehoboth as the white knight that has come to our rescue for our
Police Chief's "abuse of power" problem.

Therefore, she must be present at Jaran's hearing.  In hat way, she will show to
future employers that she's an effective leader, specially on Police problems a
municipality may face.

The Cape Cod Times and the Banner will have photos and coverage of her at the
hearing, and she'll describe us to Rehoboth as a small gang of malcontents, that
any person in a top spot has, at one point or another.  Helping enhance her
image as a great leader will be Elaine Anderson, and those others in town that
gave her a glowing written reference when she applied unsuccessfully for the Bar
Harbor job.

All of these theatre-like performances will be orchestrated behind the scenes by
the same individual who orchestrated, while sitting in the back and watching,
the glowing statements made about Jaran, the night Sharon Lynn suspended with
full pay, at Town Hall.

The truth of what happened is quite different.  Due to her stagnation, things
with Jaran got worse.  Had she been an effective leader, he would have been
handled quickly and decisively.  And who knows...he may be still with us, but
she took care of this not being possible.  The only one to be blamed is Sharon
Lynn, her direct supervisor.  Let's hope that she takes Jaran to Rehoboth as its
Police Chief.  She owes him that.

Yes, Sharon has given her 30 day notice. Yes, within that 30 day
period, there will be a disciplinary hearing for her close friend and fellow
cop, Jeff Jaran. As it stands now, she will be part of the decision-making
process determining what, if any, punishment is appropriate. In my opinion, this
is 100% wrong. Rather than let her get away with a final slap to the Town's
face, I propose that at this Monday's meeting, the Selectmen vote to accept her
resignation EFFECTIVE IMMEDIATELY. There is absolutely no need for her to hang
around, arranging for ethics classes for Selectmen and Town employees, which
will be held in January. Whatever duties need to be completed are in David
Gardner's very capable hands. He has been doing most of her tasks for sometime
now and, by Charter, becomes the Acting Town Manager once she departs. Thank her
for whatever good things she says she has accomplished, then wish her well and
let the Town begin to heal. The festering boil of her r!
egime needs to be lanced NOW.

future--will go directly to the Mayor and to Reheboth Beach Commissionsers and
to the public.

Best Sharon leaves now--or takes 30 days to do nothing here. Otherwise, that at
will contract will surely be broken faster than Sharon thinks it can.

reach Reheboth Beach--and it will--she will have a short term at the helm.

Affordable Housing

If Austin Knight Pushed for affordable Housing Maybe It's Because

he now needs affordable housing. He needs a new place to live where he pays rent

Elaine Anderson & Sharon Lynn

When I heard that Elaine used the UU mailing list, I spoke with the
Rev Kate and the president of the UU board.  I know that the UU has been very
involved in voting rights issues and that they would want to know. They said
that Elaine accessed the mailing list on her own without permission, but that it
was not illegal.  They did speak to her and asked her not to do it again and they
made a policy so that it could not happen again. Members of the UU asked Elaine
to apoligize to the congregation but she never did. When I brought this issue up
to the selectmen, I was slapped down by Tom Donegan whose response was that we
need to get beyond the campaign.

I wish Sharon Lynn well.  I am sorry that she is leaving with all this baggage,
even if she did do it to herself.  Another example of the need to not cover up
anything. For me, she was a breath of fresh air after Keith Bergman.  Somewhere
down the line she got too involved with the cabal and their interests and
stopped listening to the rest of us. I'm glad she will get another chance to do
it right in a new town.

Slap on the Wrist

What is being done to make sure Shadon Lynn (a "Lame Duck" Town
Manager who has tendered her resignation) and Austin Knight (an unetical
Selecman named as part of the Marcum investigation) from taking part in the
Chief of Police  disiplinary hearing .  There is certainly a conflict of
interest here. If not legally, then at lest morally (realize it is an oxymoron
mixing the word morals, Austin Knight, and Sharon Lynn in the same sentance).

It is not beyond comprehension that the two of these amoral individuals will
vote to give the Police Chief  nothing more than the proverbial "Slap on the
Wrist" for all of his misdeeds.

Police Chief Jaran


Is it true that both Austin Knight and Sharon Lynn will be weighing in on the
fate of our corrupt police chief?  There is something absolutely wrong if the
two of them are allowed to decide the fate of chief Jaran.  Sharon Lynn hired
chief Jaran, and Austin Knight violated election protocol by having chief Juran
electioneer for him.

If the two of them are part of the disiplinary process then the State Doard of
Ethics should be contacted before this happens.  This must be illegal, and if it
is not then it is certainly morally wrong.

Resulting from the "Elaine incident", the UU immediately added a disclaimer

If you disagree with the way someone does there job as an elected official give
REAL reasons not simplified BS.  State policy disagreements in terms of the
policies, not lots of subjective innuendo. Stop with the very unAmerican guilt
by association.

that you disagree with.  You lose most of your credibility by running off at the
mouth with all kinds of venom that seems to be very personal.

Election 2014

I hope folks think long and hard and ask lots of questions re: Candidacy of Ms
Andrews, do we really think the second time around will be better than the
first? Can we try to stop repeating the same mistakes of the past! We can do

Agree- Selectmen are here to first and foremost protect and have the best
interest of the provincetown people as their most important priority; not
their own self interest especially promoting a specific selectmen candidate at

This clearly shows the character of that individual and TRULY shows Elaine's
REAL person. She is a self centered individual who does not  belong on our BOS.

Same goes for Austin. We all know his recent involvement with the last election
and the police dept. These two individuals DO NOT belong on our BOS. They are
underserving and do not have the character, morals and ethics we as provincetown
prople deserve in a selectmen.

How they hold their head high is beyond me. I believe they both suffer from some
sort of Narcissistic condition.Some say they are an embarrassment to provincetown.
I go further and say they are a danger to have on our BOS and should be removed.

They have an agenda. Plain and simple. Look at Elaine's recent glowing statements
in reference to Sharon Lynn. Our Town Manager who allowed all these improprieties to
go on.

Yes - and NOBODY can tell me she didn't know. She helped push many that were
brought to her attention under the rug. When she leaves, I believe much more
will come out and the blame will go directly to her. She is hiding quit a bit.
 
However, she is now going. We MUST work on "dethroning" these 2 self centered
narcissists NOW.

required to file a disclosure through the Town Clerk, something she should be
congizant of as a former board member and two-term selectman, positions that

Elaine is in trouble -- big time.

Austin Knight - I Feel Betrayed

A few days before our last election, I was approached and asked to
consider voting for Austin, which I did.
But I didn't know then all the negative baggage that Austin carried.  I came to
town after the sexual harassment allegations against him had been made. Nor did
I know about questions that had bent raised concerning his working in
construction without the necessary licenses.  This all is bring talked about
around town because of his using the Police Department as a sort of an Austin
Knight's Campaign Headquarters.

Now... I can't even look at him.  I feel betrayed.

It's statements like the kind above that make me question the theory of
evolution.  Let me try explaining this to you.  I'll use simple words.

First, any "non-governmental organization" can get involved in an election.
However, if such an organization has requested, and been granted exemption from
paying taxes, then the organization can't get involved in helping SPECIFIC
CANDIDATES in any federal, state or local election.  Doing so would jeopardize
the organization's tax-exempt status.  And that's exactly what Ms. Anderson did. 
She sent an e-mail blast around town in which she indicated that she was
supporting two specific candidates, and asked people to consider voting for
these two individuals.  When she sent this e-mail, she could've easily sent it
from her own e-mail address.  But Ms. Anderson didn't; instead she chose to send
the e-mail using the UU's e-mail address.  I don't believe the UU gave her
permission to do this.  Nobody in their right mind would approve such a foolish
thing.  That Ms. Anderson, who has been involved in the UU Church as well as in
politics for quite a few years, made such an error is!
  baffling.  Makes me question her thought process when making policy decisions
which affect all of us.

on the Truro taxpayers. This town is like a cancer, it just keeps spreading and

Do they really think Truro is going to want to be any part of this towns messes?
No police chief, no TM, one useless selectman (McChesney), one corrupt one
(Knight), one blathering fool (Anderson) and two other selectmen that talk a lot
but haven't really done much on their own. Oh ya, that sounds like a great offer
to Truro.

You know, sometime i read what people write on this blog, and i have to ask
myself, did someone write that because they are clueless or just to stir the
pot? I don't know. All i know is that if a church claims tax exemption for
religious purposes, it is not allowed to participate in political campaigns. So
here we are , in Provincetown. Supposedly a hotbed of enlightened, progressive
people. and we have the Chairman of the Board of Selectmen allowing &
encouraging  the Police department to further his campaign and election, and you
have the vice chairman (Elaine) using the property (email blast lists) of a
tax-exempt church to support and further Austin's political campaign. Where did
these people come from? My word. Please, send them BACK !

The Rehoboth Beach commissioners unanimously approved named Sharon Lynn as Rehoboth’s new city manager.


Lynn, formerly town manager of Provincetown, Mass., will start Monday, Jan. 6. Retiring City Manager Greg Ferrese, who will officially retire Thursday, Dec. 5, will stay on as acting city manager until Lynn takes over. Lynn was not present at the Dec. 2 special commissioners’ meeting when the agreement was approved.


Commissioner Stan Mills said Lynn was the best fit for the city. The city received 100 applications for the job, and Mills said Lynn, who has been Provincetown’s town manager for seven years, stood out above all the rest for her experience in a town comparable to Rehoboth.


Lynn said she was excited to begin and that Rehoboth is a good fit for her.

City Solicitor Glenn Mandalas, who served as the city’s point man in drafting the agreement, said she seemed eager to accept the opportunity in Rehoboth and was very easy to negotiate with.

“She’s looking forward to this relationship,” Mandalas said.


Originally from the Philadelphia area, Lynn, 59, said she vacationed in Rehoboth all the time when she served as both a police officer and town manager in West Goshen Township, Pa. She said the city's search firm, Novak Consulting group, contacted her about the position and she decided to apply. Lynn said she thought the time was right to make the switch.


The resolution approved by the commissioners is not so much a contract as it is an employment agreement. The relationship between Lynn and the city is on an “at will” basis meaning there is no term or length of employment. It also means, either side can end the relationship. Lynn will be paid $120,000 in base salary, $21,000 less than the reported $141,000 she made in Provincetown.

The total compensation was higher than the city’s targeted range of $90,000 to $110,000. At the Dec. 2 meeting, Mayor Sam Cooper expressed displeasure over the salary, saying it exceeded what he expected to spend. However, he said he was satisfied with the choice of Lynn to fill the shoes of Ferrese, who is retiring after 31 years.


The agreement also includes vacation time, paid holidays, health and dental insurance and $15,000 of deferred compensation in a 457(b), a tax-deferred retirement savings plan for government employees similar to a 401(k) for private employees. As part of the agreement, Lynn must reside in Sussex County within 10 miles of Rehoboth.


The city will reimburse Lynn up to $5,000 for relocating to Rehoboth. Lynn said she plans to look for a home when she arrives; until then, she said she has temporary accommodations worked out.

The only discussion came when Mills suggested codifying that Lynn should give a minimum of 60 days notice before resigning. However, that suggestion was rejected after Commissioner Bill Sargent and Cooper said the city should not further negotiate an agreement both sides have already agreed to.


Commissioners Lorraine Zellers and Mark Hunker said it was important for the commissioners to put Lynn in a position to succeed.


Hunker said, “It’s our onus to make sure that we make this choice successful.”

"I know I have very big shoes to fill. If I can be as good as city manager as Greg, then I'll be happy," Lynn said. I'm very anxious to start."

Boat Crushing Machine Converted into Paper Shredder

Nonsense News has learned that Town Of Provincetown's Official Boat Crushing
Machine has been transformed into a huge paper shredder. Local dorymen were
relieved from a having to post a beach sentry to guard their boats and have now
begun to camp at the OC pending the return of the boat crusher.

DPW document transfers were disguised as a trash truck and rushed back and forth
from the Award Winning Town Hall to the DPW facility. In an effort to maintain
secrecy the document shuttles have been code named "curriers". In a similar
attempt to preserve secrecy Town Hall officials have code named the the
shredding room "Groll Hall"

Sharon as the new city manager of Rehoboth Beach. Her start date will be no

Sharon Lynn - They Made Her an Offer!

REHOBETH BEACH "AT WILL" EMPLOYMENT AGREEMENT

According to the audio transcript from this morning's Board of Commissioner's
meeting, Sharon Lynn's new city manager position will provide her with a very
nice compensation package.

Starting on or before Jan. 6, 2014, Sharon will be compensated $120K per year
plus an annual $15K retirement contribution. She is also eligible for
reimbursement of up to $300/month for a car allowance, and either a
city-provided cell phone or reimbursement for her personal cell phone expenses.
The City of Rehoboth Beach will also provide up to $5K for her moving expenses.

One interesting discussion occurred regarding the terms of notice should either
party terminate the employment. The Commissioners approved the agreement
unanimously.

We should all recognize that Sharon is leaving to accept a new position in a
community where the incumbent has been employed for over three decades. Her
predecessor in Provincetown was replaced while he was searching for a new job.

No thoughts about the truth of the sexual harassment charges since I
have not seen or heard any statements under oath from any of the parties.  My
guess is that neither has any poster here.  It might be best to get the facts
from both sides before deciding on guilt or innocence.  After all, that is the
American Way.  The campaign stuff and the employee charges are unrelated and
should have no bearing on deciding the truth.  If a charge was made to the MCAD
then it will be heard at that level and not in PT.  Fair is fair.  Don't try to
lead a lynch mob.  Stick with facts, not biases.

The Sexual Harassment Article on Austin Knight is Shocking

It is predatory and clearly using his position to gain sexual advantag3e over a
town employee. and it makes NO sense that Sharon Lynn who be the one to
investigate. Austin Knight is HER boss and how could she be objective. Of course
she would dismiss the case and I think they dismissed the town employee who
accused Austin Knight of this sexual harassment. Knight is explicit in what he
wants to do and is physical with this town employee. This is inappropriate and
illegal and a moral outrage.

This behavior and the complicit working with Jeff Jaran to distribute his own
campaign signs and the use of police to threaten those who would not vote for
Knight is not the behavior fitting a Chair of the board of Selectmen. This is
not the behavior fitting a mason either!

Over the Thanksgiving weekend the Provincetown's historic siren was blown off
the roof of the award winning Town Hall;, The siren lay derelict on the
southeast stairway surrounded by freshly painted rotten wood knocked off the
building as the siren crashed to the ground.

First used to summon volunteer firefighters to the scene of  an active fire and
later to warn of an impending nuclear attack, the siren was thought to be no
longer operational and was purely an ornamental historical detail on the award
winning Town Hall.  In an EXCLUSIVE BREAKING NEWS ALERT, Nonsense News has
confirmed reports, that the siren has been tuned to a frequency heard only by
secret remote transponders and has been used by the Town Hall officials to
summon Candy Corps to the latest political fight.  Reports also confirm every
time the siren was to be sounded, A Knight would jump up and down squealing
"CanIPushTheButton-CanIPushTheButton-CanIPushTheButton" until the Town Manager
smiled at the eager beaver and calmly instruct, "yes Austin, it's time to push
the button. Go ahead now. Push hard Austin".The Town Manger would then send A
Knight to wait on the stairs to open the door for Commander Candy when she
arrived at the award winning Town Hall.

In a paranormal twist the Siren  was knocked to the ground as a freak wind gust
swept over Town Hall from the West End just as the final documents were signed
to transfer Candy Cottage to new owners.  It is widely believed the cabal was
determined not to let the siren codes become another public document request.

Town Hall siren was sounded whenever two or more  FinCom members entered Town
Hall. Recently the secret codes were  decoded by Mike Canizales,  In response to
the secret alerts, Canizales set up The Candy Defense Task Force.  Described as
Charlie's Angles with calculators,  Candy Defense would pummel  Town Hall 
personnel with a hail of actuarial assumptions on the present value of future

The BOS should accept Sharon's resignation effective immediately. She
NOT be allowed to have any role in determining the punishment handed out to the
chief. By turning a blind eye to all of his actions, she essentially gave him
permission to run amok in our Town. Because they are both cops, she undoubtedly
try to cut him some sort of sweet deal which will cost us even more money. I
think that Tom and Erik should do everything in their power to stop this. I am
assuming that Good Knight Austin will have to recuse himself as that would be an
outrageous conflict if he did not.Call a special meeting and give her her
walking papers NOW!

Knight? In a few months the remaining two of "The Three Stooges" will be gone
and the town can once again function normally.

Resignation Effective Immediately!

I believe it is outrageous that Ms. Lynn intends to preside over Chief
Jaran's discipline hearing. I also feel Ms. Lynn's resignation should be
accepted effective immediately. What possible good can be achieved by her
obvious conflict of interest in a lame duck role? We have to pay her but we can
cut our losses by ushering her out as would be the case in any similar private
sector situation.

My Overall Opinion

Forget about Austin Knight - How can we. He is
such a        in more ways than one .. as is Elaine Anderson. You can't trust
them as far as you could throw them. Someone should check into Austin's
background .. you'll be surprised. I say let him and Elaine go .. better with 3
of them than to have those two. Such cut throats.

The Board of Selectmen have not been truly productive since Michelle Couture
was Chairman - she started [it] all a lot of this 'cause she is a        herself.

Now on to a new Board of Selectmen - note that Cheryl Andrews is going to run
again. Finally - someone who knows how to be a professional Board Member.
She's a cracker jack! Knows her business and won't put up with a lot of shit that
has been going on for years. 

From what I was told by many people Sharon was all hugs and kissed when she
first came to town - and then changed over night. Too many lies to too many
people - you get caught in them and sooner or later the bubble burst.
And that is what happened to her.

Give some credit to where credit is due. MANY town employees MADE things
happen - she took credit when she should have recognized others for their
accomplishments.

Enough said - just hope everyone will take a deep breath and move forward.  A
whole new outlook and changing of the guard is in order.

Morally, practically, and legally, Mr. Knight has no business representing us at
that table, or making decisions on behalf of the citizens of Provincetown.
Nor should the other four Selectmen condone him, for if they do, their character
would be seriously questioned.

If you are talking about Kim H. You have lost all credibility. She is no trust
fund baby. She lives off the child support checks from her 2 ex-husbands. There
is no family money, never has been, and she is not socially connected in any
way. There was never an Inn in her family. If she told you that you were duped. 
You should work for the National Equirer at least you'd get paid for making
stuff up there.
